Heard Mr. R.M.H. Jabali, learned Advocate for the Applicant and Mr. T.G. Khan, learned APP for the State. 2.
By the present Application, the Applicant is seeking Bail in Crime No.71 of 2022 registered at Kothrud Police Station, Pune. 3.
Mr. T.G. Khan points out to the order dated 15th January, 2025 passed by this Court in Criminal Bail Application No.3758 of 2024 and submits that the liberty granted in the said order, is required to be availed before the learned Trial Court, at the first instance.

In view of the above, Mr. R.M.H. Jabali, learned Advocate for the Applicant, on instructions from the Applicant Gayatri Shimpi
2-BA-2710-2025.doc craves leave to withdraw the present Criminal Bail Application and to file a fresh Bail Application before the learned Trial Court in terms of the liberty granted by order dated 15th January, 2025 passed in Criminal Bail Application No. 3758 of 2024. Liberty as prayed for is granted.

Mr. R.M.H. Jabali, learned Advocate for the Applicant submits that the Applicant would file a fresh Bail Application before the Trial court, within a period of 10 days from today. He prays that the learned Trial Court be directed to dispose of the Bail Application expeditiously. If, such Application is filed within a period of 10 days from today, the learned Trial Court to consider the same on its own merits and in accordance with law. Considering the observations made in paragraph No. 2 of the order dated 15th January, 2025, the learned Trial Court is requested to make an endeavor to dispose of the such Bail Application, if filed within 10 days from today, expeditiously and at any rate within a period of six weeks from the first date of hearing in the said Application.

Criminal Bail Application No. 2710 of 2025 is dismissed as withdrawn with liberty as above.
