Heard Mr. Satyam Nimbalkar, learned Advocate for the Applicant and Ms. Anamika Malhotra, learned APP for State. 2.

By the present Application filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS"), the Applicant is seeking following relief :

"a.

Release the Present Applicant on bail in connection with C.R. No. 294 of 2017 registered at Pangari Police Station u/s 302,307,120(B), 147,148,149, 323 of Indian Penal Code and under section 4 and 25 of Arms Act on such terms & conditions as this Hon'ble Court may deem fit in the interest of justice."

On 11th July, this Court had made following order : "1.

Heard Mr. Padmasinh P. Patil, learned Advocate for the Applicant and Mr. A. A. Palkar, learned APP for the

State.

Mr. A. A. Palkar points out to an order dated 2nd July, 2025, by which Criminal Bail Application No.2561 of 2025 filed by the present Applicant is listed on 8th July, 2025. He submits that the Applicant is before this Court seeking Bail in the same offence, by way of two Bail Applications.

Mr. Padmasinh P. Patil, learned Advocate for the Applicant, states that is not aware of the Second Bail Application No.2561 of 2025, and he requires time to verify. He prays for time till Friday.

In view of the statement made by the learned APP, though Criminal Bail Application No. 2561 of 2025 is scheduled on 6th August, 2025, the same is preponed to 18th July, 2025 along with the present Bail Application. 5.

At the request of the learned Advocate for the Applicant and by consent of parties, list the present Bail Application and Criminal Bail Application No. 2561 of 2025 on 18th July, 2025."

Mr. Satyam Nimbalkar, learned Advocate for the Applicant states that present Application is second bail application filed by the Applicant before this Court during the pendency of the first Bail Application (Criminal Bail Application No. 2561 of 2025). He submits that he has instructions from the Applicant to unconditionally withdraw the present Bail Application as the other Bail Application (at Serial No. 907 of today's board) is pending before this Court. 5.

Ms. Anamika Malhotra, learned APP for the State and Mr. Atharva R.B., learned Advocate for the Complainant states that they have no objection for the Applicant to unconditionally withdraw the present Bail Application.

In view of the statement made by Mr. Satyam Nimbalkar, learned Advocate for the Applicant to unconditionally withdraw the present Bail Application, leave granted.

Criminal Bail Application No. 2713 of 2025 is dismissed as withdrawn.
