By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 396 of 2023 registered with Chandan Nagar Police Station for the offence punishable under Section 302 of the Indian Penal Code, 1860 ("IPC" for short).

After having heard the matter for some time and upon this Gitalaxmi

3-BA-2725-2025.doc Court having expressed its view of not being inclined to entertain the present Application, Mr. Harsh Kashyap, learned Advocate for the Applicant on instructions from the Applicant craves leave to withdraw the present Application with liberty to file an Application before the learned Trial Court after the oral testimony of the eye witness is completed. Leave as prayed for is granted. 4.

In the event any fresh Bail Application is filed by the Applicant before the learned Trial Court upon completion of the oral testimony of the eye witness, the same shall be considered on its own merits and in accordance with law.
