This motion is made on behalf of learned counsel for applicant for the recall of the order dated 09.03.2026 (hereinafter referred to as order under clarification) passed in the present bail application.

It is brought to the notice of this Court that during the pendency of the present application, the applicant had preferred a subsequent bail application, which came to be allowed by this Court vide order dated 10.09.2025 in Criminal Bail Application No. 3274 of 2025 and the applicant was enlarged on bail. 3.

The aforesaid fact was not brought to the notice of this Court when the present application was taken up for final hearing on 09.03.2026. Consequently, this Court proceeded to decide the application on merits.

In view of the fact that the applicant had already been granted bail prior to the passing of the order under clarification, the present application had, in effect, become infructuous and did not warrant adjudication on merits.

Accordingly, the order dated 09.03.2026 is hereby recalled, as it was passed in absence of full disclosure of the above-stated facts.

It is further clarified that the earlier order granting bail to the applicant shall continue to operate in accordance with law. (Sachin S. Deshmukh, J.) Omkar Joshi
