Learned counsel for the Applicant submits that there is no evidence in the charge-sheet in order to connect the Applicant with this Crime except for the statement of the witness - Naresh. It is argued that the said statement came to be recorded after five months of he allegedly seen the Applicant in the office of courier company. In any case, it is his submission that mere presence of the Applicant in the courier company by itself, is not an incriminating circumstance. According to him, there is no evidence to show that phone number appearing in the panchanama belongs to the Applicant. It is also argued that there is no acknowledgment indicating grounds of arrest being furnished to the Applicant nor the grounds were communicated to the relatives of the Applicant. 23rd April, 2026.
