By this Application, Applicant is seeking regular bail in Crime No.1095 of 2024 registered with Hinjawadi Police Station, Pune, for the offences punishable under Sections 310(2), 316(2), 61(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 ('BNS' for short). 2.
It is prosecution's case that, on 25th September 2024 at around 1.00 p.m., the Applicant and the co-accused robbed an amount of approximately Rs.2 crores from the First Informant.

It is contention of learned counsel for the Applicant that, the allegations against the Applicant are of conspiracy. The co-accused Mahesh Hotkar having similar allegations has been released on bail by learned Sessions Court. Hence, the Applicant is entitled for bail on principle of parity, and requested to allow the Application. 4.
It is contention of learned APP that, the Applicant is main conspirator. He called all the co-accused. The CDR shows that there are call records between the Applicant and co-accused. The Applicant instigated the co-accused to rob the First Informant. If Applicant released on bail,. he may abscond or threaten prosecution witnesses, and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The co-accused Mahesh Hotkar having similar allegations has been released on bail. Considering these facts, the Applicant is entitled for bail on principle of parity and I pass following order. 7.
Considering these facts, I pass following order.
ORDER
(i) The Applicant-Akhilesh Shriram Chaudhari be released on bail in Crime No.1095 of 2024 registered with
Chindwadi Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount. (ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
