The Registry has not placed papers of the present matter before this Court. Hence, I was compelled to refer the papers from the learned APP appearing in the matter, so as to avoid inconvenience to the parties.

The Applicant seeks bail in connection with the C.R. No.24 of 2019 dated 19th January 2019 registered with the D.N. Nagar Police Station, Mumbai for the offences punishable
under Sections 302 and 201 of the Indian Penal Code, 1860 ('IPC'). The Applicant is in custody since 25th January 2019. 3.
At the outset, Ms. Anuja Gotad, learned APP representing the State in the matter, states that the trial has commenced and one witness is already examined. She also submits, on instructions, that the prosecution intends to examine as many as 20 witnesses. There is an antecedent against the Applicant pertaining to the offence punishable under Section 420 of the IPC. The Applicant was on parole and surrendered after more than 2 years.

Since the trial is already underway and the maximum prescribed sentence is that of life imprisonment, I am not inclined to enlarge the Applicant on bail at this stage. 5.
The Bail Application is accordingly, rejected and stands disposed of.

Since the trial has already commenced and one witness is examined, trial be concluded expeditiously and preferably within one year from the date on which this order is communicated to the Trial Court concerned.
