By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant (Accused No. 2) is before this Court seeking regular bail in connection with Crime No. 361 of 2017 registered with Pimpri Police Station, Pimpri-Chinchwad for the offences punishable under Sections 302 read with 34 of the Indian Penal Code, 1860, Section 4(25) of the Arms Act, 1959 and Sections 37(1) & 135 of the Maharashtra Police Act, 1951. Said Crime No. 361 of 2017 is registered as Sessions Case No. 765 of 2017 and is pending on the file of learned Additional Sessions Judge, Pune.

Ms. Anamika Malhotra, learned A.P.P. points out to the order Gitalaxmi
13-BA-2841-2025.doc dated 21st June 2021 passed in Bail Application No. 2102 of 2019 and submits that the Applicant having withdrawn the said Bail Application, in the event of change in circumstances and on any other ground for bail as available in law, the Applicant is required to approach the Trial Court at the first instance. 4.
Mr. Vaibhav Chandanshive, learned Advocate for the Applicant on instructions from the Applicant seeks leave to withdraw the present Bail Applicant to file a fresh Bail Application before the learned Additional Sessions Judge, Pune in Sessions Case No. 765 of 2017, by seeking bail on the ground of parity and other grounds as available to the Applicant. He submits that such Application would be filed within a period of 10 days from today and therefore prays that the learned Additional Sessions Judge, Pune, be directed to expedite the decision on such Bail Application. Liberty as prayed for by the Applicant is granted. In the event of such Bail Application being filed before the learned Additional Sessions Judge, Pune, within a period of 10 days from today, then the same shall be considered on its own merits and in accordance with law. The learned Additional Sessions Judge, Pune is requested to make an endevour to dispose of such Application expeditiously and at any rate within a period of three weeks from the first date of hearing in the said Application. 5.
