Heard the learned Counsel for the parties.

This is the third application for bail before this Court. The Applicant is arraigned in C.R.No.542 of 2017 registered with Powai Police Station for the offences punishable under Sections 302, 363, 364 read with Section 34 of the Indian Penal Code, 1860. The first application being BA No.1599 of 2023 was dismissed as withdrawn on 24 April 2024. By the said order, the learned Sessions Judge seized with Sessions Case No.273 of 2018 arising out of C.R.No.542 of 2016 was requested to make an endeavour to conclude the trial as expeditiously as possible and, preferably, within a period of seven months from the date of the communication of the said order. 3.
The second application being BA No.549 of 2025 was also dismissed as withdrawn on 13 March 2025, as the trial had progressed and 3-4 SSP 1/2
5 ba 2861 of 2025.doc witnesses remained to be examined. As the trial did not conclude, the Applicant has again preferred this application. 4.
Now the trial has reached an advanced stage and the last of the three IO's is under cross-examination. It transpired that, in the intervening period, adjournments were also sought on behalf of the applicant. The court is now informed that the last witness for the prosecution is to be cross-examined on 18 March 2026.

As the trial is on the verge of completion, the application stands disposed with a request to the learned Sessions Judge to conclude the trial in Sessions Case No.273 of 2018 as expeditiously as possible, and, preferably, by 30 April 2026.

It is, however, made clear that the applicant shall not seek any adjournment before the trial Court and shall co-operate with the trial Court in the expeditious conclusion of the trial.
