The Applicant is in custody from 2nd May, 2023. The charges have not been framed till date despite chargesheet having been filed in April, 2022. The learned counsel for the Applicant states that the Applicant was in Saudi Arabia for his job. Hence, a Look Out Circular (LOC) was issued against him at the behest of the Police.

Ms.Khan, learned appointed Advocate for Respondent No.2, has raised justifiable apprehension, based on the material on record, that it is likely the Applicant, if enlarged on bail, may intimidate the victim during the trial. In these circumstances, I am of the view that the present Bail Application will be considered once the statement of the victim is recorded before the Trial Court.

The Trial Court is requested to frame charges and record the statement of the victim within a period of three months from the date on which this order is placed before it. 4.

Stand over to 2nd February, 2026.

In the meantime, liberty is granted to the Applicant to mention the matter for hearing in case the statement is recorded by the Trial Court earlier. (DR. NEELA GOKHALE, J) 11th November 2025
