Heard Mr. Sachin Thorat, learned Advocate for the Applicant and Mr. Pandurang Gaikwad, learned APP for the Respondent-State. 2.

By the present Bail Application, the Applicant is seeking Bail in Crime No.491 of 2024 registered with Satana Police Station, District Nashik.

After having heard the matter for substantial time and when this Court expressed its view of not being inclined to entertain the Application, Mr. Sachin Thorat sought a passover. 4.

After some time the matter was taken up at the request of Mr. Sachin Thorat. Mr. Sachin Thorat, on instructions from the Applicant craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the learned Trial Court in the event of Gayatri Shimpi

4-BA-2879-2025.doc change in circumstance. Mr. Pandurang Gaikwad, learned APP for the State does object to the liberty sought by the Applicant. 5.

In view of the above, leave granted to withdraw the present Bail Application. Applicant is always at liberty to file a fresh Bail Application before the Trial Court in the event of change in circumstance. If such an Application is filed, the same shall be considered on its own merits and in accordance with law. 6.

Criminal Bail Application No. 2879 of 2025 is dismissed as withdrawn with liberty as prayed for.
