Learned counsel for the Applicant submits that there is no evidence in order to indicate that the Applicant has prepared himself for committing the crime in question. It is her contention that there is a reason to accept that the incident has occurred on the spur of the moment, and hence the offence punishable under Section 302 cannot be attributed to the Applicant. She also seeks bail on the ground that, after framing of charges in December 2025, not a single witness has been examined before the Trial Court till date.

Learned APP opposes the application by pointing out the evidence on record in the form of witness statements, postmortem notes, etc. 17th March, 2026.

Since the charge has already been framed and evidence is likely to commence before the Trial Court, this Court does not wish to record any finding on the merit of the application as the same is likely to cause prejudice to the parties in the trial. Suffice it to say that, at this stage, the Applicant is not entitle for bail.

Learned APP, on instructions, makes a statement that the trial would be completed within a period of one year from today. Considering the said statement, if the trial is not concluded, liberty is granted to the Applicant to move a fresh application for bail.

In view of the above, Bail Application stands dismissed.
