By this application, applicant is seeking regular bail in IRESH MASHAL C.R. No. 66 of 2023 registered with Pandharpur Taluka Police Digitally signed by IRESH MASHAL Date:

2025.08.26 16:50:51 +0530 Station, District Solapur for offences punishable under Sections 307, 376, 354, 363, 341, 324, 323, 504, 506 r/w 34 of the Indian Penal Code.

It is the prosecution's case that applicant had eloped with daughter of first informant and performed marriage with her. 1/4

Thereafter, daughter of the victim came to house of first informant and was staying with her but applicant was following her wherever she goes. It is alleged that on 31st January 2023, when the first informant and victim going to the college of victim as there was examination paper of the victim, when they were proceeding in auto-rickshaw, at that time, applicant intercepted the auto-rickshaw by his motorcycle and assaulted the first informant and victim with knife with intention to kill them. Due to assault by the applicant, the first informant caused injury on her thigh. Thereafter, applicant kidnapped the victim on his motorcycle. It is the contention of the learned counsel for the applicant that applicant is behind the bar for more than two years. There is no progress in trial. Victim is wife of applicant. The injury suffered by the first informant was not on the vital part of her body. If this Court imposes condition, applicant will follow it and he will not file application for relaxation of condition and requested to allow the application. 3.

It is the contention of learned APP that applicant had sexually assaulted the victim. Victim is not the wife of the applicant. Applicant was stalking the victim. When she was not 2/4

responding, applicant with an intention to kill the first informant and victim, assaulted them with knife. If applicant is released on bail, he may threaten first informant, prosecution witnesses and requested to reject the application. 4.

I have heard both learned counsel, perused F.I.R. and documents produced on record. Investigation is completed and charge-sheet has been filed. Applicant is behind the bar for more than two years. There is no progress in trial. Charge is not framed yet. It may take time to conclude the trial. The first informant suffered injury on her thigh.

Considering these facts, further detention of applicant is not required and I pass following order :

O R D E R

I.

Application is allowed.

II.

Applicant be enlarged on bail in C.R. No.

66 of 2023 registered with Pandharpur Taluka Police Station, District Solapur on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.

III. Applicant shall not tamper with the 3/4

evidence or attempt to influence or contact the witnesses or any person concerned with the case.

IV.

Applicant shall attend the Trial Court dates, regularly.

V.

Applicant shall not enter in Pandharpur Taluka till recording of evidence of the victim and the first informant, except attending the Court dates.

VI.

Applicant shall not contact the first informant and victim.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order. 8.
