By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 85 of 2025 registered with Ambad Police Station, District-Nashik City for the offences punishable under Sections 318(4), 316(2), 336(2), 338, 336(3), 340(2), 308(2), 308(5), 61(2), 352, 351(2) & 351(4) of the Bharatiya Nyaya Sanhita, 2023, Section 39 of the Maharashtra Money Lenders Act, 2014 and Sections 3(2)(ii), 3(2), 3(4) & 3(5) of the Maharashtra Control of Organized Crime Act, 1999.

76-BA-2919-2025.doc He submits that the Bail Application bearing No. 923 of 2025 filed by the Applicant, was filed prior to filing of the charge-sheet. Said Bail Application was rejected on 24th June 2025. He submits that the prosecution has now filed the charge-sheet in the matter. He therefore on instructions from the Applicant, craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court on account of change in circumstances arising out of filing of the charge-sheet. 4.

Ms. Madhavi Mhatre, learned A.P.P. for the State/Respondent does not object to the grant of request made by Mr. Onkar Wable, learned Advocate for the Applicant.

Applicant is always at liberty to file a fresh Bail Application before the learned Trial Court in the event of chance in circumstances. If such Application is filed by the Applicant before the learned Trial Court on the ground of change in circumstances, the same be considered on its own merits and in accordance with law.
