Heard Mr. Amit Icham, learned Advocate for the Applicant and Ms. Veera Shinde, learned APP for the State-Respondent. 2.

By the present Application filed under Section 439 of the Code of Criminal Procedure the Applicant is seeking Bail in connection with Crime No. 224 of 2022 registered with Yavat Police Station District Pune for offences punishable under Sections 376(2)(n), 354, 452, 509, 506 of the Indian Penal Code, Sections 4, 8 r/w 12 of the Protection of Children from Sexual Offences Act, 2012 ("POCSO Act" for short). 3.

After having heard the matter for substantial time and this Court having expressed its view of not being inclined to entertain this Application, Mr. Amit Icham, learned Advocate for the Applicant, on instructions from the Applicant, craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the learned Trial Court upon conclusion of the examination / oral testimony Gayatri Shimpi

Ms. Veera Shinde, learned APP, does not object to the requests made by Mr. Amit Icham.

In view of the above, leave granted to withdraw the present Bail Application, with liberty to file a fresh Application for bail before the learned Trial Court upon completion of the examination/ oral testimony of prosecutrix (victim). If such Application is filed the same shall be considered on its own merits and in accordance with law. 6.

Learned Advocates for the parties submit that they would cooperate with the learned Trial Court in early disposal of the trial. 7.

Criminal Bail Application No.2932 of 2025 is dismissed as withdrawn with liberty as prayed.
