By this Application, Applicant is seeking regular bail in Crime No.311 of 2024 registered with Khed Police Station, District-Pune, for the offences punishable under Sections 307, 504 and 506 read with Section 34 of the Indian Penal Code, 1860 ('IPC' for short), 2.
It is prosecution's case that, on 15th May 2024 at around 8.30 p.m., the Applicant and co-accused assaulted the son of the First Informant with an intention to kill him.

It is contention of learned counsel for the Applicant that, the Applicant is behind bar since one year and six month. There is no progress in trial. The co-accused having similar allegations has been released on bail and requested to allow the Application.

It is contention of learned APP that, the Applicant assaulted the son of First Informant with an intention to kill him. If Applicant released on bail, he may abscond or threaten prosecution witnesses and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The First Informant present in Court. The learned counsel for the First Informant, on instructions, submits that, he has no objection to allow the Application.

The Applicant is behind bar for more than one year and six months. There is no progress in trial. The co-accused having similar allegations have been released on bail.

Considering these facts, I pass following order.
ORDER
(i) The Applicant-Siddhesh Khandu Tanpure be released on bail in Crime No.311 of 2024 registered with Khed Police
Station, District-Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount. (ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
