By the present application under Section 439 of the Code of Criminal Procedure, 1973, Applicant is seeking bail in connection with C. R. No.98 of 2023 registered with Satara Taluka Police Station, Satara, for the offences punishable under Sections 406, 408, 409, 420, read with 34 of the IPC and under Section 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishment) Act, 1999.

Mr. Ramnik Pawar, learned Advocate for the Applicant submits that there is a subsequent event which according to him would be change in circumstances. He submits that subsequent to
1-ba-2951-2025.doc the order dated 23.05.2025 rejecting bail to the Applicant, prosecution has filed inquiry report dated 23.05.2025, conducted under Section 88 of the Maharashtra Cooperative Societies Act, 1960 before the Trial Court. He therefore craves leave to withdraw the present bail application with liberty to file a fresh bail application before the Trial Court in Special Case No.102 of 2023 on the ground of change in circumstances.

Ms. Veera Shinde, learned APP for the State, does not object to the said recourse suggested by Mr. Ramnik Pawar. 5.
In view of the above, Applicant is granted leave to withdraw the present application with liberty to file a fresh application for bail before the learned Trial Court, on the ground of change in circumstances. If such application is filed, the same be considered on its own merits and in accordance with law. 6.
Bail Application No.2951 of 2025 is dismissed as withdrawn. (ASHWIN D. BHOBE. J.)
