Heard learned counsel for the Applicant and Learned APP for State.

By this Application, the Applicant is seeking regular bail in Crime No. 249/2019 registered with Shikrapur Police Station, Pune for the offences punishable under Sections 302, 364, 201, 34 of the Indian Penal Code, 1860.

It is prosecution's case that deceased was murdered by the Applicant and co-accused on the ground that accused no.1 had enmity with the deceased. Initially, the offence was registered against unknown person. In investigation, it revealed that Applicant and co-accused

murdered the deceased.

It is contention of learned counsel for the Applicant that the coaccused Mayur Hajare, against whom similar allegations are leveled, has been released on bail by this Court [Coram: Prakash Naik, Former Judge]. Hence, Applicant is entitled for bail on principle of parity and requested to allow the Application.

Learned APP fairly submitted that parity will be application to the present Applicant.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

As co-accused, having similar allegations, has been released on bail. Applicant is entitled for bail on principle of parity. 8.

Considering this fact , I pass following order.

ORDER

(i) The Applicant- Swapnil Ganpat Hajare be released on bail in Crime No. 249/2019 registered with Shikrapur Police Station, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in

accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
