Mr. Saurabh Tandale i/by Mr. Abdul Quadir, Advocate for the applicant Mr. A.S. Salgaonkar, APP for State .......
CORAM : NITIN B. SURYAWANSHI, J.
DATE : 13th JANUARY, 2026 ORDER :
1.
Applicant seeks bail in Crime No. 168 of 2024 registered with Akkalkot North Police Station, Solapur Rural for the offences punishable under Sections 302, 307, 504, 506 of the Indian Penal Code.
2.
Prosecution case is that applicant and his brother/informant were staying along with their mother. On 05.04.2024, at about 8.00 am, when the informant was at the home, applicant quarreled with his mother on account of money and he was threatening to kill her by smashing her head by stone. Informant intervened and pacified the quarrel and left for Solapur for work. When Bhagyawant Punde
{2} 58-BA-3001-2025 he returned at 11.30 pm, even at that time, mother and applicant were quarreling. Applicant was abusing her and threatening to kill her. He pushed her and made her fall down and smashed her head with stone. Informant admitted the mother in the hospital. With these allegations, FIR was lodged, which was initially lodged under Section 307, 504, 506 of IPC. During the course of treatment mother expired and Section 302 was added in the present crime. 3.
Heard the learned advocate for the applicant and learned APP for State. Perused the record.
4.
Applicant has killed his mother for trivial reason. Informant is an eye witness. Medical evidence supports the prosecution case. 5.
Taking into consideration the involvement of the applicant in a serious offence of commission of murder of his mother, gravity of the offence and the manner in which the offence is committed, applicant does not deserve discretionary relief of bail. Application is therefore rejected.
