Heard Ms. Pooja Agarwal, learned Advocate for the Applicant. She submits that the entire prosecution case is based on circumstantial evidence. She submits that the last seen theory put forth by the Applicant is with reference to the Accused No.1 and the Applicant (Accused No. 2) being last seen together. She submits that even if the allegations in the FIR are considered then the Applicant was found standing near the scene of offence. She submits that no motive is attributed to the Applicant.
