Heard Mr. Ramanik Pawar, learned Advocate for the Applicant. He submits that statements under Section 183 Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS") of the Manager Rahul Uttam Ganake and eyewitness Ajinkya Shankarrao Patil have been recorded by the learned Magistrate. He submits that in both the statements the Applicant is neither named nor any role in the crime is assigned to the Applicant. He submits that the charge-sheet though refers to CCTV footage of the crime the same does not support the prosecution case against the Applicant.

Ms. M. H. Mhatre, learned APP for the State appears and waives service of notice. She submits that she needs time to take instructions with reference to the CCTV footage to ascertain whether the Applicant is seen in the CCTV footage.
