The present bail is sought in connection with R.C.C. No.54/2024 pending before the JMFC Court, Saswad which 1/3

arises from FIR No.38/2024 registered under the provision of 454, 457, 380 read with Section 34 and Section 120B of the Indian Penal Code. The trial in this matter has commenced. Except one witness who is Investigating Officer and panch witnesses all the witnesses are examined. The case of the prosecution is that during the general election of the Lok Sabha, EVM machines at Mauje Saswad, Tal. Purandar, District Pune were kept in the strong room and were sealed. At that time the complainant found that the lock of the strong room was broke open and EVM machine was taken away illegally. 2.

The Applicant was arrested in said offence on 7th February 2024. I have perused the chargesheet with the assistance by the learned Counsels appearing for the parties. The offence is very serious.

Coupled with the facts that the entire trial is almost over. The statement of witnesses cannot be doubted at this stage. Apart from that, there is recovery at the instance of the Applicant. In the facts of this case, I am not inclined to grant the present bail. Hence, Bail Application stands rejected.
