By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 636 of 2017 registered with Mohol Police Station, Solapur Rural for the offences punishable under Sections 80(2), 115(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

When the matter was called out, Mr. Amit Palkar, learned A.P.P. has submitted that the prosecution has filed charge-sheet before the learned Trial Court and the said crime is registered as Gitalaxmi

Mr. Bhalchandra Shinde, learned Advocate submits that as the prosecution has filed the charge-sheet, as stated by Mr. Amit Palkar, learned A.P.P., he therefore on instructions from the Applicant seeks leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the learned Additional Sessions Judge, Solapur on account of the change in circumstances arising out of filing of the charge-sheet. Not objected to by Mr. Amit Palkar, learned A.P.P. Leave as prayed is granted. If any such Bail Application is filed by the Applicant before the learned Trial Court, then the same shall be considered on its own merits and in accordance with law.
