By this Application, the Applicant is seeking regular bail in Crime No.785 of 2023 registered with Shirur Police Station, Pune for the offences punishable under Sections 307, 326, 341, 364(A), 384, 385, 386, 387, 120B, 504 and 506 read with Section 34 of the Indian Penal Code, 1860 ('IPC' for short) and Section 3(25) of the Arms Act. 2.
It is prosecution's case, on 2nd September 2023, the Applicant and co-accused kidnapped the First Informant and
threatened him on the point of pistol demanded ransom of Rs.10 lakhs. The First Informant showed his inability to give such amount, then they asked him to arrange Rs.1 lakh, on arranging said amount, the Applicant and co-accused took Rs.1 lakh from him and assaulted him. In the said assault left hand of the First Informant was fractured. 3.
It is contention of learned counsel for the Applicant that the allegations against him are he was following the car, in which First Informant was kidnapped, he has not participated on actual assault of the First Informant. The Applicant is behind bars for more than 2 years. There is no progress in trial, and requested to allow the Application.

It is contention of learned APP that the Applicant was part of group who kidnapped First Informant, assaulted him and took ransom money from him. The Applicant was following car of the First Informant, it shows his involvement in crime. He has antecedents. If Applicant released on bail, he may abscond or threaten First Informant and prosecution witnesses and requested to reject the Application. 5.
I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The allegations against the Applicant are that, when coaccused kidnapped First Informant in car, the Applicant was following the said car. There are no allegations against the Applicant of assaulting the First Informant. The Applicant is behind bars for more than 2 years. There is no progress in the trial 7.
Considering these facts, I pass following order.
ORDER
(i) The Applicant-Dnyaneshwar @ Mauli Shrikant Pabale be released on bail in Crime No.785 of 2023 registered with Shirur Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) The Applicant shall attend the concerned Police Station as and when required.
(vi) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
