Considering that the charges are not framed as yet and at the time of incident, the Applicant himself was 19 years of age and has suffered incarceration from 16th August 2023, which is more than two years, I am of the view that it will meet ends of justice, if the Trial Court is requested to frame charges and record the statement of the victim, a minor at the time of the incident within three months from the date this order is placed before the Trial Court.

In terms of the above, Ms. Ayesha Maldar, learned Counsel for the Applicant, seeks permission to withdraw the present Bail Application with liberty to renew her prayer for bail once the deposition of the victim is recorded by the Trial Court.

Permission to withdraw is granted with the aforesaid liberty.

The present Bail Application is accordingly disposed of as withdrawn.
