Heard Mr. Nilesh Nidhalkar, learned Advocate for the Applicant, Mrs. Rajeshree Newton, learned APP for the Respondent No. 1 and Mr. Tejas Kothalikar, learned Advocate for the Respondent No. 2.

By the present Application the Applicant has sought for the following substantive relief in terms of prayer clause (a):- a. Grant regular bail to the applicant in connection with C.R. No. 153/2024 registered at Sahakar Nagar Police Station, Pune for the alleged

offences;

After having heard the matter for some time, Mr. Nilesh Nidhalkar, learned Advocate for the Applicant, sought a passover to take instructions from the Applicant. After some time, at his request, the matter was taken up.

Mr. Nilesh Nidhalkar, learned Advocate for the Applicant, on instructions from the Applicant seeks leave to withdraw the present Application with liberty to apply to the Trial Court upon examination of the Respondent No. 2 (Victim). The request made by Mr. Nilesh Nidhalkar, is not objected to by Mrs. Rajeshree Newton, learned APP and Mr. Tejas Kothalikar, learned Advocate for the Respondent No. 2.

In view of the statement made by Mr. Nilesh Nidhalkar, learned Advocate for the Applicant, leave is granted to withdraw the present Application with liberty to apply to the Trial Court after oral testimony of the Respondent No. 2 (Victim) is recorded in Special Case No. 904 of 2024 pending on the file of the Additional Sessions Judge, Pune.

If a fresh Bail Application is filed by the Applicant, same be considered on its own merits and in accordance with law. 7.

Bail Application No. 3050 of 2025 is disposed of as withdrawn.
