Heard Mr. Abhijeet Kandarkar, learned Advocate for the Applicant and Mr. Tanveer Khan, learned A.P.P. for the State/Respondent.

By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 242 of 2025 registered with Yeola Taluka Police Station, District-Nashik Rural for the offences punishable under Sections 80(2), 108 and 85 of the Bharatiya Nyaya Sanhita, 2023. 3.

Mr. Tanveer Khan, learned A.P.P. for the State/Respondent on instructions from the Investigating Officer submits that the Gitalaxmi

4-BA-3150-2025.doc investigation is still in progress and on instructions submits that the charge-sheet would be filed positively within a period of 3 weeks from today. Prosecution to abide by the said statement. 4.

On the basis of statement made by Mr. Tanveer Khan, learned A.P.P. for the State/Respondent, Mr. Abhijeet Kandarkar, learned Advocate for the Applicant, on instructions from the Applicant, craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court upon filing of the charge-sheet.

Mr. Tanveer Khan, learned A.P.P. does not object for grant of the request made by Mr. Abhijeet Kandarkar, learned Advocate for the Applicant.

In view of the above, leave as prayed for by the Applicant, is granted. If such Bail Application is filed by the Applicant before the learned Trial Court, then the same shall be considered on its own merits and in accordance with law.

Criminal Bail Application No. 3150 of 2025 is disposed of as withdrawn with liberty as prayed.
