After arguing the matter for some time, Mr. Francis A Caszo, learned Advocate appearing for the Applicant sought permission to withdraw the present Bail Application. Permission to withdraw is granted. Bail Application No. 3167 of 2025 is disposed of as withdrawn.

Since there is an order dated 3rd January, 2024 granting liberty to the Applicant to seek bail fresh, after a period of one 10th February 2026

Gayatri Shimpi (P.A.) 22-BA-3167-2025.doc year from 3rd January, 2025 if there is no substantial progress in the trial, today, Mr. Mayur Sonavane, learned APP for Respondent No. 1 - State and Ms Sagayamary M., learned Advocate for the Respondent No. 2 have brought to my attention the roznama/ case status of the Trial Court. The roznama dated 4th November, 2025 indicates that the Applicant refused to participate and co-operate in the framing of charges. Hence, the Trial Court was unable to frame the charges.

It is thus clear that the delay in conducting the trial is not on account of the prosecution, but it is completely on account of the Applicant as he refused to co-operate with the trial.

In the circumstances, the Trial Court is requested to expedite the trial.
