By this application, applicant is seeking regular bail in Crime No.72 of 2023 registered with Sangli Police Station, District Sangli for the offences punishable under Sections 8(c), 20(b)(ii)(c), and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. (for short 'NDPS Act').

It is prosecution's case that on secret information, police intercepted one vehicle and in search of said vehicle, police found 102 Kg. Ganja along with seven persons. The applicant is one of it. 3.
It is contention of learned counsel for applicant that co-accused Sachin Babaso Chavan, who was present in the vehicle at the time of incident has been released on bail by this Court (Coram : Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:

ASHWIN D. BHOBE, J.) vide order dated 27th June, 2025. The allegations against Sachin Chavan and the applicant are same. Hence, the applicant is entitled for bail on the principle of parity. Hence, requested to allow the application.

It is contention of learned APP that commercial quantity of Ganja was found in the vehicle in which the applicant was present. Applicant has two antecedents. If applicant is released on bail, he may abscond or threaten the prosecution witnesses. Hence, requested to reject the application 5.
I have heard both learned counsels, perused the FIR and documents produced on record. The allegations against the applicant and the co-accused Sachin Chavan are same, who has been released on bail by this Court. Considering these facts, the applicant is entitled for bail on the principle of parity. Considering these facts, I pass the following order :
ORDER
(i) Application is allowed;
(ii) The applicant be enlarged on bail in Crime No.72 of 2023 registered with Sangli Police Station, District Sangli, on executing P.R.Bond in the sum of
Rs.20,000/- with one or two sureties in the like amount.
(iii) The applicant shall not tamper with the evidence or attempt to influence or shall not contact the witnesses or any person concerned with the case. (iv) Applicant shall attend the Trial Court dates, regularly.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
