Heard Ms. Sana Khan, learned Advocate for the Applicant and Ms. Anamika Malhotra, learned APP for the State. 2.

By the present Application, Applicant is seeking bail in Crime No. 1058 of 2020 registered with Kondwa Police Station. 3.

Ms. Anamika Malhotra, learned APP points out pages 324 to 327 and submits that the Bail Application of the Applicant was rejected by the Trial Court on 10th October, 2023. Bail Application filed by the Applicant was rejected on merits by this Court on 18th July, 2024. Special Leave to Appeal No.10609 of 2024 filed by the Applicant was dismissed by the Hon'ble Supreme Court on 12th August, 2024. She submits that in the event of change in circumstances, the Applicant would have to first move the learned Trial Court at the first instance. In view of the objection raised by Ms. Anamika Malhotra, learned APP for the State, Ms. Sana Khan, learned Advocate for the Applicant, on instructions from the Applicant seeks leave to withdraw the present Bail Application and file a fresh Bail Application before the learned Trial Court on the ground of change in circumstances. She submits that such Application would be filed within 10 days from today. 5.

Ms. Anamika Malhotra does not object to the requests made by Ms. Sana Khan, learned Advocate for the Applicant. 6.

In view of the of the statement made by Ms. Sana Khan, leave granted to withdraw the present Bail Application with liberty to file a fresh Bail Application before the learned Trial Court on the ground of change in circumstances, if any. If such an Application is filed within 10 days from today, the learned Trial Court is requested to make an endeavour to dispose of the same at the earliest and preferably within a period of two months from the first state of hearing in such application. 7.

Criminal Bail Application No. 3262 of 2025 is disposed as withdrawn with liberty as prayed for.
