Learned counsel for the Applicant submits that except the statement of the co-accused i.e. Accused No.1 there is no evidence against the Applicant to connect him with the crime. It is his submission that the said statement of the co-accused has no evidentiary value and hence the Applicant deserves to be enlarged on bail. To support his submission for seeking bail, reference is made to the order dated 7th January, 2026, passed by this Court in ABA No.3598 of 2024 granting anticipatory bail to the Accused No.3. It is his submission that the said co-accused, in whose factory premises the contraband was claimed to have been manufactured, is granted pre-arrest bail. On these among the other submissions he seeks bail.

Learned Spl. PP for NCB opposed the application. He, by drawing attention of the Court to the documents relied upon by in CR No.17 of 2024, states that there is CDR available indicating the evidence against the present Applicant.

Since the learned Spl. PP sought to contend that the CDR is not placed before the Court, an opportunity to verify the fact that as to whether the CDR forms the part of charge-sheet, time is granted.
