2.

It is prosecution's case that on 21st September 2023, around 9.15 p.m., the Applicant and co-accused kidnapped the First Informant

and co-accused forcibly took out Rs.20,000/- from his bag. He was threatened and compelled to make phone calls to his family members and asked to pay Rs.1 crore, it was reduced to Rs.12 lakhs and thereafter it was reduced to Rs.5 lakhs.

It is contention of learned counsel for the Applicant that the Applicant is behind bars for more than two years. The provisions of MCOC are applied after the present crime. There is no progress in the trial. Hence, requested to allow the Application. 4.
