Heard Mr. Marmik Shah, learned Advocate for the Applicant. He submits that the Applicant is the Manager who was present at the time of incident. He submits that the Applicant is not involved in any overt act in the incident. He relies on the C.C.T.V. footage of the incident which is at page 169 of the paper book wherein the Applicant is referred to. He submits that the said document does not indicate the Applicant having participated in the assault on the victim/deceased.
