The Applicant seeks bail in connection with Crime No.0057 of 2024 dated 15th July 2024 registered with Naroli Police Station, Dadra and Nagar Haveli for the offences punishable under Sections 103 and 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023. 2.

In short, it is the case of the prosecution that on the fateful day, an incident occurred wherein a dispute arose between the consumers of the bar and the staff members. The dispute arose over the insistence of the Informant and his friends for service to them after working hours. It is alleged that in the said incident, the Informant and the witnesses were assaulted by the staff members. In the said assault, Victim- Sandip Dhodi suffered injuries and succumbed thereto.

Learned counsel for the Applicant submits that the Applicant has no criminal history. He drew attention of the Court to the charge-sheet, which according to him, does not indicate any role of Applicant in the crime. He therefore, seeks bail. 4.

The learned Special Public Prosecutor opposes the Application by citing seriousness of the crime. 5.

Prima-facie, perusal of the record does not indicate any overt act being committed by the Applicant in the alleged assault caused on the Informant and witnesses. The Applicant has no criminal history and is not likely to flee from justice, if released on bail. Hence, following order:

ORDER

(i) The Bail Application stands allowed in connection with Crime No.0057 of 2024 dated 15th July 2024 registered with Naroli Police Station, Dadra and Nagar Haveli; (ii) The Applicant be released on bail on furnishing P.R. Bond of Rs.30,000/- with one or two sureties in the like amount to the satisfaction of the Trial Court;

(iii) The Applicant not to interfere into the evidence of the prosecution in any manner whatsoever;

(iv) The Applicant to attend all the dates of hearing before the Trial Court except exempted by a specific order by the Trial Court;

The Bail Application stands disposed of.
