Learned counsel for the Applicants submits that the Applicants are behind bar for last six years and the trial has not commenced, as not a single witness has been examined by the prosecution till date. It is his submission that apart from the merits of this case, on this ground itself, the Applicants are entitled for bail.

Learned APP on instructions from the Investigating 1/2
14-ba3330-25.doc Officer, who is present in Court, makes a statement that charge has already been framed and tomorrow before the Trial Court, the informant would be examined. She further makes a statement on instructions that the trial would get over within a period of six months from today.

Considering the prima-facie material on record and the statement made by the learned APP of conclusion of the trial within a period of six months from today, this Court finds not appropriate to grant bail at this stage. However, liberty is granted to the Applicants to prefer fresh application for bail if the trial is not concluded within a period of six months from today.
