By this Application, Applicant is seeking regular bail in Crime No.625 of 2024 registered with Pimpri Police Station, Pune, for the offences punishable under Sections 74 and 78 of the Bhartaiya Nyaya Sanhita Act, 2023 ('BNS' for short).

It is prosecution's case that, on 4th July 2024, when First Informant, aged 14 years, was returning from school, at that time, the Applicant followed her and outraged her modesty.

It is contention of learned counsel for the Applicant that, the Applicant is behind bar for more than 1 year. There is no progress in trial. The Applicant is Karta of his family. It may take time to conclude the trial. Hence, requested to allow the Application. 4.
It is contention of learned APP along with learned counsel for the Respondent No.2 that the Applicant has four antecedents. After committing this offence, he was absconding. If the Applicant is released on bail, he may abscond or threaten prosecution witnesses, and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The maximum sentence prescribed for the offences applied against the Applicant is upto three years. The Applicant is behind bar for more than one year. There is no progress in trial. It may take time to conclude the trial.

Considering these facts, I pass following order.
ORDER
(i) The Applicant-Bhushan @ Bhusha Mohan Kharate be released on bail in Crime No.625 of 2024
registered with Pimpri Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not enter in jurisdiction of the Pimpri Police Station till recording of evidence of the First Informant, except attending Court dates.
(iii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iv) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(v) Application is allowed in the aforesaid terms. .
