By this Application, Applicant is seeking regular bail in Crime No.83 of 2024 registered with Chikhali Police Station, Pimpri Chinchwad, District-Pune, for the offences punishable under Sections 376, 417 and 506 of the Indian Penal Code, 1860 ('IPC' for short). 2.
It is prosecution's case that, the Applicant had friendship with the First Informant. He called her at his house and sexually assaulted her and threatened her not to disclose this fact to anyone.

It is contention of learned counsel for the Applicant that, the Applicant is behind bar for almost two years. There was love affair between the Applicant and First Informant, who is major. The sexual relationship between them was consensual. There is no progress in trial and requested to allow the Application. 4.
It is contention of learned APP along with learned counsel for the Respondent No.2 that, the Applicant sexually assaulted the First Informant by calling her to his house and threatened her to not to disclose the incident to any person. If Applicant released on bail, he may abscond or threaten First Informant and prosecution witnesses, and requested to reject the Application.

I have heard all learned counsel. Perused charge-sheet and documents produced on record.

The First Informant is major. There is delay of more than one month in lodging the complaint. The Applicant is behind bar for almost two years. There is no progress in trial. It may take time to conclude the trial. The Applicant has no antecedents. 7.
Considering these facts, I pass following order.
ORDER
(i) The Applicant-Sudhir Sopan Jadhav be released on bail in Crime No.83 of 2024 registered with Chikhali Police Station, Pimari Chinchwad, District-Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
