By this application, the applicant is seeking regular bail in C.R.No. 123 of 2023 registered with Warje Malwadi Police Station, District Pune, for the offence punishable under Sections 307, 452, 427, 354, 354(b) of Indian Penal Code, 1860 (for short "IPC"), Sections 7 and 8 of Protection of Children from Sexual Offences Act, 2012 ( for short "POCSO Act") and under Sections 37(1)(3) r/w. 135 of Maharashtra Police Act. 2.

It is prosecution's case that on 25.03.2023, the applicant and co-accused assaulted the first informant, his mother and three sisters with wooden rod with intention to kill them.

It is contention of learned counsel for the applicant that the applicant is behind bars for more than 2 years 11 months. There is no

progress in the trial. The applicant has no antecedents. The co-accused having similar allegations have been released on bail. It may take time to conclude the trial and requested to allow the application. 3.

It is contention of learned APP along with learned counsel for intervenor that applicant and co-accused assaulted mother and sisters of the first informant on the ground of oral dispute, with intention to kill them. If applicant released on bail, he may threaten injured witnesses and requested to reject the application.

I have heard all learned counsel. Perused chargesheet and documents produced on record. The applicant is behind bars for more than 2 years and 11 months. Though charge is framed, there is no progress in the trial. The applicant has no antecedents. Investigation is completed. Chargesheet has been filed. It may take time to conclude the trial. One of the co-accused having similar allegations has been released on bail by the Hon'ble Apex Court. Considering these facts, I pass following order.

ORDER

i.

The Applicant is released on bail C.R.No. 123 of 2023 registered with Warje Malwadi Police Station, District Pune, on executing P.R.Bond of Rs.30,000/-, on furnishing one or two sureties in the like amount.

ii.

The Applicant shall attend the concerned Police Station as and when required.

iii.

The Applicant shall not tamper with evidence or attempt to influence the witnesses. The Applicant shall not contact the complainant, witnesses or any other person concerned with present case.

iv.

The Trial Court shall not be influenced by the observations made in this order and shall decide the matter on its own merits and in accordance with law.

The Bail Application is allowed in the aforesaid terms and is accordingly disposed of.
