By this application applicant seeks bail in C.R. No.22/2025, registered with Koregaon Police Station, District Satara for offences punishable under Sections 65(1), 137(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita and Sections 4, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012. 2.

Father of the victim has lodged FIR on 23/01/2025 alleging that the applicant has sexually assaulted the minor victim. Pursuant to the registration of FIR applicant came to be arrested on 24/01/2025.

Heard learned advocate for applicant, learned APP for respondent No.1 State and learned advocate representing second respondent. Perused the papers.

Charge-sheet came to be filed in the present crime on 20/03/2025. It is mentioned in the medical certificate of victim that all her internal organs are intact and there are no signs of inflammation of hymen perineum. It is opined that as per the history and examination there is a possibility of sexual harassment. It is the case of applicant that there was love affair between the applicant and victim. Fact remains that the victim is minor. 5.

The applicant is arrested in the month of January, 2025, therefore, he is behind bars since last one year. There is no possibility of his trial concluding in the near future. There is no need to further detain the applicant before trial. Applicant, therefore, deserves to be released on bail.

In the result, application is allowed. Applicant Anubhav Baban Jadhav be released on bail in connection with C.R. No.22/2025, registered with Koregaon Police Station, District Satara, on furnishing personal bond of Rs.15,000/- with one surety in the like amount. Applicant shall not enter the village Asare, Taluka Koregaon, District Satara till conclusion of the trial. Applicant shall not tamper the prosecution evidence and shall scrupulously attend the trial.

Fees of the learned advocate appointed to represent second respondent be paid by the Legal-aid as per schedule within eight weeks from today.
