Applicant seeks bail in Crime No. 221 of 2024 registered with Kadegaon Police Station, Dist. Sangali, for the offences punishable under Sections 420, 408, 406 379, 381 read with 34 of Indian Penal Code.

Prosecution case in short is that informant is engaged in production of cattle food through his company Sun Agri Industries situated in Plot No. A-05, Kadegaon MIDC, Tal. Kadegaon, Dist. Sangli. He had engaged 25 to 30 employees in the said company. Sales representative of the company namely accused Vishwanath Jaywant Pawar was residing near the company. Accused Amol Vasant Mohite
{2} was transporting goods in the company by his vehicle No. MH-10-DT2430. Both of them used to sale goods in the market and deposit sale price in the company. In the month of January-2024, difference was found in the account of company. When internal assessment audit was conducted, difference of Rs. 78,91,803/- was found with regard to raw material during 01.04.2022 to 18.07.2024. It is also noticed that accused Vishwanath had accepted cash as well as online payment regarding goods sold in the market, but he had not deposited the said amount in the company and thereby, they had misappropriated amount of Rs. 2,24,81,726/-.

Heard learned advocate for the applicant and learned APP for the State. Perused the record.

Applicant seeks bail on the ground of parity as Accused No. 1- Vishwanath alias Gaurav Jaywant Pawar is released on bail by the Sessions Court vide order dated 12.09.2025.

Applicant is arrested on 14.02.2025. Charge sheet in the present crime is filed on 12.03.2025 and the case is numbered as R.C.C. No. 35/2025. The prosecution has cited 64 witnesses in the charge sheet. Till date, charge is not framed.

In the light of above, applicant is entitled to be released on bail on the ground of parity and delay in conducting trial. The application is therefore allowed.

Applicant- Sanjaykumar Ramkesh Patel be released on bail in Crime No. 221 of 2024 registered with Kadegaon Police Station, Dist. Sangali, for the offences punishable under Sections 420, 408, 406 379, 381 read with 34 of Indian Penal Code on executing Personal Bond of Rs. 50,000/- with one surety in the like amount. 8.
Applicant shall attend the trial regularly and shall not tamper the prosecution evidence.
