Learned Counsel for the Applicant submits that the Applicant is arrested on 18th December, 2019 and inspite of the fact that the charge has been framed on 20th July, 2022, not a single witness has been examined by the prosecution. On merit, it is submitted that there is inconsistency in the statement of informant Riyaj Safil Ahmed Khan, who in his statement before the Magistrate under Section 164 of Cr.P.C., gives altogether different version of the incident. It is further submitted that his statement runs contradictory to the statement of alleged eye witnesses.

Learned APP opposed the said submission by contending that statements of eye witness are sufficient to show an involvement of the applicant in serious crime like murder. He further submits that there is evidence in the form of statements of witnesses which could show that the applicant's involvement in the crime. He seeks time to verify as to whether the statement placed on record by the Counsel for the Applicant is a statement of Riyaj Khan recorded under Section 164 of Cr.P.C. 3.
