By this Application, Applicant is seeking regular bail in Crime No.71 of 2023 registered with Wadiwarhe Police Station, Nashik, for the offences punishable under Sections 307, 435, 109, 120B, 504 and 506 read with Section 34 of the Indian Penal Code, 1860 ('IPC' for short), Sections 3 read with section 27 of the Arms Act. 2.

It is prosecution's case that on 17th March 2023, the Applicant and the co-accused fired at the First Informant and his friend

with intention to kill them on the ground of vacating land. It is alleged that co-accused chased the First Informant and his friend with sickle in his hand with an intention to kill them.

It is contention of learned counsel for the Applicant that the Applicant is behind bars for more than ten months. He has no antecedents. It may take time to conclude the trial. The co-accused having similar allegations has been released on bail, and requested to allow the Application.

It is contention of learned APP that the allegations against the Applicant are serious that he fired from his pistol at First Informant and other witnesses with an intention to kill them. The bullets fired by the Applicant got stuck in tress and hit the tin shed where the First Informant was residing. If Applicant released on bail, he may abscond or threaten First Informant and prosecution witnesses. Hence, requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The Applicant is behind bars for more than ten months. He has no antecedents. It may take time to conclude the trial. The co-

accused having similar allegations has been released on bail. 7.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Anil Rajendra Satpute be released on bail in Crime No.71 of 2023 registered with Wadiwarhe Police Station, Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not enter in Nashik District till recording of the evidence of the First Informant. (iii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iv) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(v) The Applicant shall attend the concerned Police Station as and when required.

(vi) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
