By this application, applicants are seeking regular bail in C.R. No. 253 of 2025 registered with Khed Police Station, District Ratnagiri for offences punishable under Sections 420,, 409, 406, IRESH MASHAL 120(B), 467, 465 r/w 34 of the Indian Penal Code and under Sections Digitally signed by IRESH MASHAL Date:
2025.12.12 15:12:05 +0530 3 and 4 of The Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999.

It is the prosecution's case that the applicants are the directors of the Shamrao Urban Co-operative Credit Society Limited. The co-accused have taken loan amount from the said Pat Sanstha without any valid documents and misappropriated the property of Pat Sanstha. The applicants were aware about the said fact but they
helped the co-accused in misappropriation of the Pat Sanstha amount. 3.
It is contention of learned counsel for applicants that the applicants joined as directors in the said Pat Sanstha in the year 2023. Some of the said amounts were disbursed prior to joining of applicants as directors. The applicants were not aware about the cheating by the co-accused. Applicants are behind bar for more than three months. Investigation is completed and charge-sheet has been filed. Hence, requested to allow the application. 4.
It is contention of learned APP alongwith learned counsel for intervener that applicants were directors of said Pat Sanstha. The co-accused had obtained loan from the said Pat Sanstha without any loan proposal or other documents. There was involvement of the applicants in the said crime. If applicants are released on bail, they may tamper the evidence. Hence, requested to reject the application. 5.
I have heard all the learned counsel, perused F.I.R. and documents produced on record. It appears from the record that the applicants joined the said Pat Sanstha in the year 2023. Some of the amounts were disbursed prior to the joining of the applicants as directors. Whether the applicants were aware about the sanctioning of loan to the co-accused or not is part of the trial. The applicants are behind bar for more than three months. In audit report
nothing is mentioned against the applicants.

Considering these facts, I pass following order:
O R D E R
I.
The Application is allowed.
II.
The Applicant be enlarged on bail in C.R. No. 253 of 2025 registered with Khed Police Station, District Ratnagiri on executing P.R.Bond in the sum of Rs. 20,000/- each with one or two sureties in the like amount.
III.
The Applicants shall not tamper with the evidence or attempt to influence or contact the witnesses or any person concerned with the case.
IV.
The Applicants shall attend the Trial Court dates regularly. 7.
The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
