Learned counsel for the Applicant submits that herein in this case, though the Applicant was arrested on 23rd September 2024, he was produced before the Magistrate for the first time on 30th September 2024. He further submits that there is no evidence to indicate that the Applicant is not capable of performing sexual intercourse. Apart from this, it is also his submission that even the Victim has not been medically examined, and in fact, she did not co-operate with the investigation.
