Heard learned counsel for the Applicant and learned APP. 2.

The learned counsel for the Applicant, on instructions, seeks leave to withdraw this Application with liberty to file fresh Application, if there is no substantive progress in the trial after six months and submitted that, Applicant is behind bar more than five years. Charge is framed but the trial has not commenced. Hence, direction be given to expedite the trial and conclude the trial within six months.

As the Applicant is behind bar more than four years, hence, Trial Court is requested to expedite the Trial and dispose of it as early as possible, from the receipt of the order.
