Learned counsel for the Applicant submits that after arrest, for 19 months the Applicant is behind the bar. It is his submission that the co-accused is granted bail by this Court. According to him, the Applicant cannot be kept in jail by way of pre-trial sentence. On merits, it is his submission that the allegations by number of alleged investors are not supported by material on record. Finally on long incarceration, he seeks bail. 1/3

Learned APP opposes the Application by contending that there are 10 investors from whom an amount of Rs.2.00 crores is due by the Applicant.

The Applicant was arrested on 10th September, 2024. On conclusion of investigation, chargesheet is filed against the Applicant. The charge against the Applicant is punishable with imprisonment of 7 years. Admittedly, nothing more has remained to have been investigated. This Court finds substance in the contention of the learned counsel for the Applicant that after lapse of 19 months in jail, he cannot be kept further in jail by way of pre-trial sentence. The Applicant has no criminal antecedent and he is not likely to flee from justice. Hence the following order :- O R D E R :

a).

The Application stands allowed.

b) The Applicant be enlarged on bail in connection with Crime No.509 of 2022, registered with Navghar Police Station for the offences punishable under Sections 420, 406 and 120-B of IPC as well as Section 3 and 4 of Maharashtra Protection of 2/3

Interest of Depositors (In Financial Establishment) Act, 1999, on furnishing PR bond of Rs.30,000/- with one or two surety in the like amount for the satisfaction of the Trial Court. c).

The Applicant to attend the hearing of the trial on each dates unless exempted by the Trial Court.
