By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 32 of 2025 registered with Vishrantwadi Police Station, District-Pune City for the offences punishable under Sections 70, 70(2), 115(2), 352, 351(1)(2), 64(1), 75, 79, 351(2)

(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3(a), 4, 5(g), 6, 8 & 12 of the Protection of Children from Sexual Offences Act, 2012.

Mr. Dilip Bodake, learned Advocate for the Applicant submits that the abovesaid crime is registered as Special Case No. 457 of 2025 and is pending before the Court of Special Judge (under Gitalaxmi

15-BA-3516-2025.doc POCSO Act) & Additional Sessions Judge, Pune. 4.

Mr. Dilip Bodake, learned Advocate for the Applicant submits that the Forensic Report in respect of the mobiles, is still awaited. He on instructions from the Applicant craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court in the event of change in circumstance. 5.

Mr. Dinesh Haldankar, learned A.P.P. for the State/Respondent does not object for grant of the request made by Mr. Dilip Bodake, learned Advocate for the Applicant. In view of the above, leave to withdraw the present Bail Application is granted. 6.

Applicant is always at liberty to file a fresh Bail Application before the Trial Court in the event of change of circumstance. If such Application is filed by the Applicant before the Trial Court on the ground of change of circumstance, the same be considered on its own merits and in accordance with law.

Criminal Bail Application No. 3516 of 2025 is disposed of as withdrawn with liberty as prayed.
