By this Application, the Applicant is seeking regular bail in C.R.No. 347 of 2024 registered with Upnagar Police Station for the offences punishable under Sections 109, 309(2), 115(2), 352(2), 3(5) of Bhartiya Nyaya Sanhita, 2023 (for short "BNS Act") and under Section 4/25 of Indian Arms Act, 1959.

It is prosecution's case that on 08.10.2024 at around 00:30 a.m., the Applicant and co-accused assaulted the deceased with a sharp weapon with an intention to kill him due to old dispute. It is alleged that Applicant assaulted on the head of the first informant

with sickle.

It is contention of learned counsel for the applicant that the applicant is behind bar for one year and three months. There is no progress in the trial. The co-accused having similar allegations has been released on bail. Hence requested to allow the application. 4.

It is contention of learned APP that the role attributed to the applicant and co-accused are different. The applicant assaulted on the head of the first informant with sickle with an intention to kill him. The applicant has two antecedents. If applicant is released on bail, he may abscond or may threaten the prosecution witnesses, hence requested to reject the application.

I have heard both the learned counsel. Perused FIR and documents produced on record. The applicant is behind bar for one year and three months. There is no progress in the trial. The Applicant and the co-accused assaulted the first informant. The coaccused has been released on bail. It may take time to conclude the Trial. Considering these facts, I pass following order.

ORDER

i.

The applicant be released on bail in C.R.No. 347

of 2024 registered with Upnagar Police Station, on executing P.R.Bond of Rs. 30,000/- on furnishing one or two sureties in the like amount.

ii.

The applicant shall attend the concerned police station as and when required.

iii.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

iv.

The Trial Court shall not be influenced by the observations made in this order and shall decide the matter on its own merits and in accordance with law.

6.

The Bail Application is allowed in the aforesaid terms and is accordingly disposed of.

7.

All concerned to act on the authenticated copy of this order.
