By this Application, Applicant is seeking regular bail in Crime No.375 of 2014 registered with Nigdi Police Station, Pune, for the offences punishable under Sections 74, 78, 79, 351(2), 115(2) and 13 Of the Bharatiya Nyaya Sanhita ('BNS' for short), 2023, Sections 7, 8, 9(f), 9(l), 9(m), 9(t), 10, 11, 12, 16, 17 and 19 of the Protection of Children from Sexual Offences Act, 2012 ('POCSO' for short) and
Sections 3(1)(w)(i), 3(1)(w)(ii) and 3(2) of the Schedule Castes and The Schedule Tribes Act ('SCST Act' for short). 2.
It is prosecution's case that the Applicant has outraged the modesty of the First Informant's minor daughter on various occasions The victim was student of the Applicant.

It is contention of learned senior counsel for the Applicant that the Applicant is behind bars for more than one year. There is no progress in the trial. The Applicant has retired from his service. It may take time to conclude the trial, and requested to allow the Application. 4.
It is contention of learned APP along with learned counsel for Respondent No.2 that the, Applicant has been convicted under the provisions of the POCSO Act, while on bail in said matter, he has committed the present offence. If Applicant released on bail, he may abscond or threaten victim and prosecution witnesses, and requested to reject the Application.

I have heard all learned counsel. Perused charge-sheet and documents produced on record.

The Applicant is behind bars for more than one year. The allegations against him are outraging modesty of the victim. The
Applicant is retired from his school service, where victims are studying. 7.
Considering these facts, I pass following order.
ORDER
(i) The Applicant-Nivrutti Devram Kalbhor be released on bail in Crime No.375 of 2014 registered with Nigdi Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not enter in Pimpri Chinchwad city till recording of the evidence of the victims, except attending Court dates.
(iii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iv) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(v) The Applicant shall attend the concerned Police Station as and when required.
