By this Application, Applicant is seeking regular bail in Crime No.135 of 2023 registered with Talegaon Dabhade Police Station, Pune for the offences punishable under Sections 302, 504 and 506 of the Indian Penal Code, 1860 ('IPC' for short).

It is prosecution's case that, on 23rd March 2023 around 11.30 p.m. the Applicant and co-accused assaulted the matrimonial uncle of the First Informant with wooden and iron rod and murdered him on the ground of old dispute.

It is contention of learned counsel for the Applicant that, coaccused having similar allegations has been released on bail. The Applicant is behind bars for more than 2 years and 10 months. There is no progress in the trial, and requested to allow the Application. 4.
It is contention of learned APP that, the Applicant is not entitled for parity as he assaulted the deceased with iron rod. If Applicant is released on bail, he may abscond or threaten prosecution witnesses. The charge is framed against the Applicant and requested to reject the Application. 5.
I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The allegations against the Applicant and co-accused Mayankar Yadav are similar. It is alleged that both assaulted the deceased and murdered him. The co-accused Mayankar Yadav having similar allegations has been released on bail. Considering this fact, the Applicant is entitled for bail on principle of parity and I pass following order.
ORDER
(i) The Applicant-Mohammad Aladin Halim, be released on bail in Crime No.135 of 2023 registered with Talegaon Dabhade Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) The Applicant shall attend concerned Police Station as and when required.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
